Terms of use of the site and content

These Terms of Use govern access to and use of the Europe Peace Foundation website at www.europefoundation.org (the “Site”).

By accessing or using the Site, you agree to these Terms of Use, our Privacy Policy and our Cookies Policy. If you do not agree, please discontinue your use of the Site.

1. Website operator

The Site is operated by:

Europe Peace Foundation (“EPF”)
Email: info@europefoundation.org
Website: www.europefoundation.org

Any additional registration, tax-identification or contact information legally required under Article 10 of Spain’s Law 34/2002 should be provided in the Site’s Legal Notice.

2. Purpose of the Site

The Site provides information about Europe Peace Foundation, its activities, programmes, initiatives, events, publications, partnerships and related resources.

The information published on the Site is provided for general informational purposes. Unless expressly stated otherwise, it does not constitute legal, financial, accounting, medical or other professional advice.

3. Acceptance and amendment of these Terms

By using the Site, you confirm that you have read and accepted these Terms.

EPF may amend these Terms to reflect legal, technical or operational changes. Updated Terms will be published on this page with a revised effective date. Changes will not apply retroactively where doing so would adversely affect rights already acquired under applicable law.

4. Intellectual-property rights

Unless otherwise stated, the Site and its content—including text, photographs, images, graphics, videos, publications, designs, logos, trademarks and other materials—are owned by or licensed to Europe Peace Foundation and are protected by applicable intellectual-property laws.

EPF grants you a limited, personal, revocable, non-exclusive and non-transferable right to access and use the Site for lawful, personal and non-commercial purposes.

You may download or print reasonable portions of publicly available content for personal, educational or internal reference purposes, provided that you:

  • Do not modify the content;
  • Do not remove copyright or ownership notices;
  • Properly acknowledge Europe Peace Foundation as the source; and
  • Do not suggest that EPF endorses you, your organisation or your activities.

Without prior written permission, you must not reproduce, republish, distribute, sell, license, commercially exploit, modify or create derivative works from the Site or its content, except where expressly permitted by law.

Requests for permission may be sent to info@europefoundation.org.

5. Trademarks and logos

The names, logos, service marks and other distinctive signs displayed on the Site may be registered or unregistered trademarks belonging to EPF or third parties.

Nothing on the Site grants a licence or right to use these marks without the prior written permission of the relevant owner. You must not use EPF’s name or logo in a manner that falsely suggests sponsorship, approval, partnership or endorsement.

6. Acceptable use

You agree to use the Site lawfully and responsibly. You must not:

  • Use the Site for fraudulent, illegal, defamatory or harmful purposes;
  • Impersonate another person or misrepresent your identity or affiliation;
  • Falsely claim that EPF endorses any statement, organisation, activity or product;
  • Attempt to gain unauthorised access to the Site, its servers or related systems;
  • Interfere with the Site’s operation, security or availability;
  • Introduce viruses, malicious software or other harmful code;
  • Collect personal data from Site users without a lawful basis;
  • Infringe another person’s privacy, intellectual-property or other legal rights;
  • Use automated tools to scrape or extract content in a manner that places an unreasonable burden on the Site or violates applicable law;
  • Circumvent security or access-control measures;
  • Frame or mirror a substantial part of the Site without written permission; or
  • Use the Site or its content for unauthorised commercial purposes.

EPF may restrict or suspend access where reasonably necessary to protect the Site, its users or third parties, or to comply with legal obligations.

7. Donations and payments

Where the Site allows donations or other payments, you agree to provide accurate, current and complete information and confirm that you are authorised to use the selected payment method.

Payments may be processed by an independent payment-service provider. That provider may process payment information according to its own terms and privacy policy. EPF may not directly receive or store complete payment-card details.

Before completing a donation or purchase, you should be informed of the amount, currency, payment method and any applicable conditions.

Unless otherwise stated, donations are voluntary. Any refund request will be considered in accordance with the applicable law, the circumstances of the payment and EPF’s published donation or refund policy. Nothing in these Terms limits mandatory consumer rights.

8. Accuracy and availability

EPF aims to keep the Site’s information accurate and current. However, information, events, laws, programmes and third-party resources may change.

EPF does not guarantee that all content will always be complete, current or free from errors. We may correct, update, remove or temporarily suspend content when reasonably necessary.

We do not guarantee uninterrupted or error-free access to the Site. Access may be interrupted for maintenance, security, technical problems or circumstances beyond our reasonable control.

9. External links and third-party content

The Site may contain links to third-party websites and services. These links are provided for information and convenience.

Unless expressly stated, a link does not constitute approval, sponsorship or endorsement. EPF does not control third-party websites and is not responsible for their availability, content, security, products or privacy practices.

You should review the terms and privacy policies of any third-party website you visit.

10. Disclaimer and limitation of liability

The Site and its content are provided for general informational purposes and, to the extent permitted by law, on an “as available” basis.

EPF is not responsible for losses resulting solely from reliance on general information published on the Site where professional advice should reasonably have been obtained.

To the maximum extent permitted by applicable law, EPF will not be liable for indirect or consequential losses arising from the use of, or inability to use, the Site.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including liability arising from fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or any mandatory consumer right.

11. User-submitted content

If you submit material through the Site, you confirm that:

  • You have the right to submit it;
  • It does not infringe another person’s rights;
  • It is not unlawful, misleading, defamatory or harmful; and
  • It does not contain malicious code.

You retain ownership of your content. However, where necessary to respond to your submission or operate the relevant service, you grant EPF a limited, non-exclusive right to store, process and use that content for those purposes.

Do not submit confidential information unless EPF has specifically requested it through an appropriate secure channel.

12. Privacy and cookies

Personal data collected through the Site is processed in accordance with EPF’s Privacy Policy.

The use of cookies and similar technologies is governed by EPF’s Cookies Policy and the choices provided through the website’s cookie-management tool.

13. Governing law and jurisdiction

These Terms are governed by Spanish law.

Any dispute shall be submitted to the courts with jurisdiction under applicable Spanish law. If you are a consumer, nothing in these Terms deprives you of any mandatory protection or right to bring proceedings before the courts competent under consumer-protection law.

14. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or limited to the minimum extent necessary. The remaining provisions will continue in effect.

15. No waiver

A failure or delay by EPF in exercising a right under these Terms does not constitute a waiver of that right.

16. Entire agreement

These Terms, together with the Privacy Policy, Cookies Policy and any additional conditions expressly applicable to a particular service, constitute the agreement governing use of the Site.

Where specific written terms apply to a donation, event, programme or other service, those specific terms will prevail in the event of a conflict concerning that service.
