They are compelled to undertake hazardous and arduous work, face fraud, legal issues, and risks of death and dismemberment, and are victims of human trafficking and smuggling. Furthermore, there are reports indicating that numerous Nepalis are residing in refugee camps across the Middle East, Europe, and America, where they encounter various legal challenges without receiving assistance or rescue from their government.

Despite having left their homeland in search of employment opportunities abroad, migrants are entitled to all rights as stipulated in the Universal Declaration of Human Rights, international human rights law, and the constitution and laws of their home country. Like all individuals, migrant workers possess the right to life, freedom from torture and other forms of cruel, inhuman, or degrading treatment or punishment, freedom from slavery or servitude, the right to legal recognition, freedom of expression, belief, and religion, personal privacy, protection against arbitrary arrest, the right to the highest attainable standard of mental and physical health, and non-discriminatory access to education, health care, and housing. They should also have the right to move and reside in a suitable location, access adequate and reasonable food and water, work in safe conditions, be safeguarded against abuses stemming from human trafficking, organize, enjoy freedom of speech and religion, receive a fair trial if accused, utilize their acquired wealth, and have safe relocation options. However, it appears that Nepali migrant workers are not fully able to exercise these rights.

Furthermore, the Government of Nepal is encouraged to generate employment opportunities within the nation, implement skill development training programs, and foster a work environment that offers competitive salaries while discouraging reliance on foreign employment.
